Malta election returning Labor party to power

VALLETTA, Malta (AP) ? An election victory is returning Malta's Labor party to power after 15 years in the opposition.

Prime Minister Lawrence Gonzi of the Nationalist Party conceded defeat on Sunday as ballots were still being counted in the island nation and eurozone member. Labor leader Joseph Muscat will be sworn in as the new prime minister on Monday.

Projections by both parties indicated a decisive victory for Labor, giving it 55 percent of the votes cast, compared to 43 percent for the conservatives.

Smaller parties took the rest of the votes, as Labor clinched its biggest victory since Malta obtained independence from Britain in 1964.

Complete results weren't expected until late Sunday, and the exact breakdown of seats in Parliament was still being determined.

Analysts said the shift in power apparently reflects voter desire for change.

The conservative Nationalists had kept unemployment at 4.3 percent and pledged to reduce taxes. But Labor promised to lower energy tariffs and fight corruption.

Milky Way's neighbor galaxy closer than thought

The distance to one of the Milky Way's next-door neighbors, a satellite galaxy that orbits its outskirts, has been determined more accurately than ever before, astronomers announced today.

The achievement could help scientists calibrate other cosmic distances, which are essential for understanding how quickly the universe is expanding and solving the mystery of?dark energy. Dark energy is the name given to whatever is tugging the universe apart and causing its expansion to accelerate.

According to the new measurement, the nearby dwarf galaxy called the?Large Magellanic Cloud?lies 163,000 light-years away.

"I am very excited because astronomers have been trying for a hundred years to accurately measure the distance to the Large Magellanic Cloud, and it has proved to be extremely difficult," Wolfgang Gieren, an astronomer at Chile's Universidad de Concepci?n, Chile, said in a statement. "Now we have solved this problem by demonstrably having a result accurate to 2 percent."

The finding was nearly a decade in the making, and required repeated precise measurements of rare pairs of binary stars that are oriented so that they eclipse each other as they orbit, from the perspective of Earth. [How Scientists Measured the Large Magellanic Cloud Distance (Video)]

Using telescopes at the European Southern Observatory's La Silla Observatory and the Las Campanas Observatory, both in Chile, Gieren and his colleagues identified eight pairs of eclipsing binaries in the Large Magellanic Cloud.

By tracking the changes in the star pairs' brightness when one star passed in front of the other, and vice versa, as well as measuring the stars' orbital speeds, the scientists could deduce the stars' sizes and masses, as well as details regarding their orbits. With this information, combined with measurements of the stars' total brightness and colors, their precise distances could be determined.

These measurements improve on previous estimates of the Large Magellanic Cloud's distance, which were all based on methods that had inherent uncertainties.

"Because the LMC is close and contains a significant number of different stellar distance indicators, hundreds of distance measurements using it have been recorded over the years," said team member Ian Thompson of the Carnegie Institution for Science in Washington, D.C. "Unfortunately, nearly all the determinations have systemic errors, with each method carrying its own uncertainties."

Pinning down the distance of the LMC, in turn, allows scientists to refine their estimates of other, farther cosmic distances. That's because the measurements of close distances are used to calibrate measurements of far-off objects. The new findings should help astronomers narrow down the?Hubble Constant, which denotes the rate of the universe's expansion, and is integral for the study of dark energy.

"We are working to improve our method still further and hope to have a 1 percent LMC distance in a very few years from now," said researcher Dariusz Graczyk . "This has far-reaching consequences not only for cosmology, but for many fields of astrophysics."

The findings are detailed in the March 8 issue of the journal Nature.

(AP) ? Facebook doesn't want to be dismissed as an Internet has-been before its social network even enters its adolescence.

In an effort to remain hip, it is infusing the focal point of its website with a more dynamic look and additional controls designed to empower its 1 billion users to sort streams of photos and other material into more organized sections that appeal to their personal interests.

The changes unveiled Thursday are an attempt to address complaints that Facebook's hub ? the News Feed ? is degenerating into a jumble of monotonous musings and disjointed pictures. This has come as users' social circles have widened from a few dozen people to an unwieldy assortment of friends, family, businesses, celebrities, co-workers and fleeting acquaintances.

That evolution requires a more nuanced approach than the computer-generated algorithms that Facebook has been relying on to pick out the most relevant content to display in each user's News Feed. The growing popularity of smartphones and tablet computers equipped with high-quality cameras also is turning the News Feed into a more visual gallery, another shift that Facebook is tackling by carving out more space to display photos and video.

Facebook Inc. CEO Mark Zuckerberg hopes the makeover turns the News Feed into something like a newspaper tailored to fit the particular interests of each user on every visit to the website.

"This gives people more power to dig deeper into the topics they care about," Zuckerberg said while discussing the makeover at Facebook's Menlo Park, Calif., headquarters.

By keeping Facebook relevant, Zuckerberg hopes to avoid the fate of his company's social networking forerunners, Friendster and MySpace. Those once-trendy sites quickly flamed out, largely because they didn't say attuned to the changing interest of fickle audience. Making that mistake is even more costly in an age of increasingly short attention spans and technological tools that make it easy to find some other diversion with a quick click of the computer mouse or the swipe of a finger on a smartphone.

"They needed to freshen things up," said Brian Blau, research director of consumer technologies for Gartner Inc. "This should bring a lot of cooler things" into the News Feed.

Although Zuckerberg didn't say it, the overhaul also appears to be aimed at carving out more space to show larger and more compelling ads within the News Feed as Facebook seeks to boost its revenue and stock price.

Previous tweaks to the News Feed have triggered howls of protest among Facebook's users. Hoping to minimize the grousing this time around, Facebook intends to roll out the changes in phases. It will probably be at least six months before everyone who accesses Facebook on a personal computer sees the revamped News Feed, the company said. New mobile applications featuring the changes should be released within that time frame too.

The transition is likely to be completed before Facebook celebrates its 10th birthday next February.

The facelift is likely to be more jarring for those who only visit Facebook on a PC because it incorporates some features already deployed in the social network's mobile applications for smartphones and tablet computers.

The new features will enable users to choose to see streams of content that may feature nothing but photos or posts from their closest friends, family members or favorite businesses. Or they can just peruse content about music, or sports, as if they were grabbing a section of a newspaper. Other newspaper-like changes will include lists of events that users' social circles have flagged for the upcoming weekend and other summaries meant to resemble a table of contents.

Facebook still intends to rely on algorithms to select some material to feature on the main part of the News Feed, much like newspaper editors determine what goes on the front page.

The additional space being devoted to photos and video is an acknowledgement how dramatically the composition of Facebook's content has changed during the past 16 months. About 50 percent of the posts on News Feed now include a photo or video now, up from 25 percent in November 2011, according to Facebook's data.

Bigger pictures also will give advertisers a larger canvass to make their marketing pitches. Facebook is hoping marketers will seize the opportunity to develop more creative ways to entice and intrigue customers so advertising can become a more acceptable fixture on the social network.

More than anything else, the changes are meant to make Facebook a more fun place to hang out.

"This is all about keeping people engaged," Blau said.

Although Facebook's website remains one of the Internet's top destinations, there have been early signs that the social network is losing some of its pizazz, particularly among younger Web surfers who are starting to spend more time on other fraternizing hubs such as Tumblr, Pinterest and Instagram, a photo-sharing site that Facebook bought for $521 million last summer.

A phenomenon, known as "Facebook Fatigue," was recently documented in a report from Pew Research Center's Internet and American Life Project. The study found that about 61 percent of Facebook users had taken a hiatus for reasons that range from boredom to too much irrelevant information to Lent.

That's a worrisome trend for Facebook because the company needs to ensure that its audience keeps coming back so it can learn more about their interests and, ultimately, sell more of the advertising that brings in most of the company's revenue.

"I don't think it had turned into a crisis, but Facebook was probably seeing some internal data that was telling them they needed to do something," said Greg Sterling, a senior analyst for Opus Research.

Facebook has been struggling to find the right balance between keeping its fun-loving audience happy and selling enough ads to please investors who want the company to accelerate its revenue growth.

Wall Street seems to think the redesigned News Feed might be a step in the right direction. Facebook's stock gained $1.13, or 4.1 percent, to close Thursday at $28.58. The shares still remain 25 percent below the $38 that they fetched in Facebook's initial public offering last May.

The mobile-friendly redesign of News Feed underscores the company's intensifying focus on smartphones and tablet computers as more of its users rely on those devices to interact on the social network.

About 23 percent, or $306 million, of Facebook's advertising revenue came from the mobile market during the final three months of last year. Zuckerberg thinks more than half of Facebook's revenue will be coming more mobile devices within the next few years ? a goal that should be easier to reach if the redesigned News Feed turns out to be as compelling as he envisions.

An international team of scientists led by Aarhus University, Denmark, has made this discovery. As the first in the world, they scanned the entire genome of hundreds of sick and healthy people to see if there is an interaction between genes and a very common virus -- cytomegalovirus -- and to see whether the interaction influences the risk of developing schizophrenia.

And it does.

Women that have been infected by the virus -- and around 70 % has -- will have a statistically significant increased risk of giving birth to a child who later develops schizophrenia if the child also has the aforementioned gene variant. This variant is found in 15 percent. The risk is five times higher than usual, the researchers report in Molecular Psychiatry.

No cause for alarm

People infected with cytomegalovirus most often do not know it, as the infection by the virus, which belongs to the herpes virus family, is usually very mild. But the researchers stress that there is no cause for alarm -- even if both risk factors are present in mother and child, there may be a variety of other factors that prevents disease development in the child.

But as schizophrenia affects 1 per cent of the global population, this new knowledge is very important.

"In the longer term, the development of an effective vaccine against cytomegalovirus may help to prevent many cases of schizophrenia," says Professor of Medical Genetics at Aarhus University, Anders B?rglum.

"And our discovery emphasizes that mental disorders such as schizophrenia may arise in the context of an interaction between genes and biological environmental factors very early in life."

Arkansas lawmakers approve toughest abortion limits in nation

Arkansas' House of Representatives on Wednesday rejected the governor's veto of a controversial bill that would make most abortions illegal after 12 weeks of pregnancy, thus setting up the most restrictive ban on the procedure nationwide.

The House vote of 56-33 followed Senate approval on Tuesday to override Gov. Mike Beebe?s veto of SB 134, or the Arkansas Human Heartbeat Protection Act, which enforces a ban on abortion earlier in pregnancy than any other state now does.

Moments before the vote, Rep. Ann V. Clemmer, who said she was pro-life, told fellow representatives they should give the right to be born to babies in Arkansas and that life was ?to be protected not only by a third party but from the mother herself.?

The state already has one of the most restrictive abortion laws in the U.S. after the Republican-led Legislature last week overrode Beebe's veto of a similar bill that set the legal abortion threshold at 20 weeks' gestation ? two to four weeks earlier than most states.

That law took effect immediately but the new measure won't until 90 days after the Legislature adjourns in mid-May.

The American Civil Liberties Union said the new law imposed the most severe ban in the country and the strictest limit on the procedure since the U.S. territory of Guam tried to ban all abortions in 1990. The group ?will challenge this dangerous and unconstitutional law in court,??the group?s executive director, Anthony D. Romero, said in a statement.

Talcott Camp, deputy director of the ACLU?s Reproductive Freedom Project, said before the vote that it was an ?unconstitutional and grotesque invasion? into private medical decisions.

?It?s a power grab by politicians. They are just looking to intrude on and take away a decision that is really for a woman and her family and her doctor, and that is true as a constitutional matter. It?s also true as a moral matter and as a matter of public health and just what?s right,? she said. ?This is not a decision for politicians to make.?

The Supreme Court has said viability of a fetus has to be left up to doctors, Camp said, adding that it was unconstitutional for state legislatures to set a number of weeks for when abortion could be banned.

Beebe, a Democrat, said in his veto letter on Monday that the ?adoption of blatantly unconstitutional laws can be very costly to the taxpayers of our state,? and that Arkansas? ?interest in protecting fetal life is simply not strong enough at such point to trump the constitutional rights of the mother.?

Matt DeCample, a spokesman for Beebe, said Wednesday after the vote: "The governor made his case very plainly in his veto letter, laid out the reasons why we feel the bill?s unconstitutional, and now it looks like it will be up to the courts to make the final decision.?

Women who want to end a pregnancy face a growing number of roadblocks in many parts of the country 40 years after the U.S. Supreme Court struck down many state restrictions on abortion with Roe v. Wade.

Last year, 19 states enacted a total of 43 provisions limiting access to abortion, according to the Guttmacher Institute, a non-profit that aims to advance reproductive health and abortion rights. While that was half the number that went into effect the previous year, it was the second-highest number since 1985.

Java is indeed a pain. But, the good news is few people actually need it in the first place. Here's what you need to know about what it does, what its problems are, and how to get rid of it.

What Is Java?

What Is Java, Is It Insecure, and Should I Use It?Java is a programming language that developers use to create applications on your computer. It isn't as popular as it once was, but chances are you've downloaded a program that required the Java runtime, and thus installed it on your system. Java also has a web plug-in that allows you to run these apps in your browser.

Java is not, however, the same as JavaScript. In fact, they don't have a ton of similarities besides their names. JavaScript is generally used within HTML documents (like web pages) rather than as standalone "apps" that run inside them. This can be a bit confusing since Java also runs in your browser, but they are quite different. A large number of web sites use JavaScript; very few require Java.

With that in mind, we're only going to discuss Java here. That's the really insecure one that's driving everyone crazy. For a better explainer on JavaScript, check out this guide from our friends at the How-To Geek. For the answer to your question, read on.

What Is Java, Is It Insecure, and Should I Use It?Java has two parts: the runtime that runs on your computer (and lets you run Java apps), and the browser plug-in that comes along with it. When people talk about Java being insecure, they're usually talking about the browser plug-in. Java apps themselves aren't inherently insecure, it's the browser plug-in that causes problems.

In fact, Kaspersky Lab says that Java was responsible for 50 percent of all cyber attacks last year, and security experts are constantly advising that you disable it in your browser. It opens up a number of holes that can allow criminals to steal passwords, credit card numbers, and other personal information. And, as you've noticed from reading news on the web, new security holes are popping up all the time.

Should I Disable it?

What Is Java, Is It Insecure, and Should I Use It?Chances are, you don't even need the Java browser plug-in. To disable Java in your browser, head to your browser's plug-in page. In Chrome, you can do this by typing chrome://plugins into the address bar, and in Firefox, you can do so by going to Tools > Add-Ons > Plugins. Then, just find Java and click Disable. That's all it takes!

The browser plug-in is the security problem in question, but the Java runtime has its own annoyances?like constantly nagging you for updates, taking up space in your system tray, and (when you first install it) because it likes to install things like toolbars on your system. For these reasons, we generally recommend uninstalling the Java runtime too, just for the convenience. If you find that an app asks for Java after the fact, you can always reinstall, as long as you keep that browser plugin disabled. To uninstall Java, open up the Start menu, search for uninstall a program, press Enter, and choose Java from the uninstall list. You'll probably be happy you did.

How to keep Facebook from annoying your friends

Facebook is using you, whether you know it or not. Sometimes it's obvious: you like a page, you click share, Facebook benefits. Other times, you have no clue until a friend asks you about a photo they saw that you liked. The unfortunate side effect to all of this is that it can actually make you an unbearable annoyance to your friends, and you probably don't even know it. Here's how it works, and how to stop it.

When we talk about the ways that Facebook uses your personal information, we're usually talking about why you should care about your privacy, or how Facebook tracks your activity. In this case, we're discussing how your Facebook habits are used ? with or without your knowledge ? to bother your friends with ads that they associate with you. It's a very different beast, but it can be stopped. Here's what you need to know.

EdgeRank: The math Facebook uses to pimp out your likes

You've probably seen an increase in posts in your news feed that say "[Your Friend] likes [Random Group]'s photo," with the full photo and text of the group's post right there, as though you liked the group yourself.

On your phone or tablet, you've likely seen "Sponsored Posts" that say "[Another Friend] likes [Random Company]" with an invitation to like that page as well. It's annoying to be sure, but you also likely know that your friend didn't choose to advertise the page to you ? it's Facebook, using our habits to get likes and shares.

The logic that Facebook uses to decide what lands in your friends' feeds is called "EdgeRank," and it's purposefully obscure ? after all, if everyone understood it clearly (and lots of people claim to, but don't), advertisers wouldn't have to pay to promote posts, and users would be able to easily filter their feeds and block ads they don't want to see.

EdgeRank serves two purposes: For people who operate Facebook pages and manage brands, it's the algorithm that decides whether your post gets out to as many of your fans as possible. For users, it's the likelihood you'll see something in your feed liked or shared by someone else. It's also the math that governs why your news feed refuses to stay in real chronological order, even after you set it to "most recent."

We're not talking about your own status updates, photos or anything you post to Facebook yourself ? just the way you interact with other pages, groups, and people on Facebook. It's one thing if your news feed is full of baby pictures from your old high school friends ? it's another thing when every post you like from a group you follow ends up in all of your friends' news feeds without you knowing or being able to control who sees it.

Facebook uses you to help pages and brands find friends and go viral

The problem: When you see a post in your news feed from a group you've never heard of, like a heartwarming photo or a campaign for a cause, you might assume it's because your friend chose to share it with their followers by clicking the "share" button. That's not the case: odds are they thought it was good, clicked Like, and moved on.

A quick way to check is to visit their profile directly: if you don't see the post there, then Facebook decided that you might like to see it too, not your friend.

This is annoying, but it's especially problematic when you click like on something that may not be work-safe, assuming that "like" is not "share," so "who'll see it, right?"

For example, one of my friends is a model: she's attractive, and her photo shoots are often artsy, but it's nothing you'd want your boss asking you about because they peeked over your shoulder at work. By "liking" her posts about her photo shoots, I run the risk of unintentionally sharing her photos with my Facebook friends, and having their bosses scold them for looking at scantily clad model pics. See the problem?

Unfortunately there's no way out of this: Facebook doesn't let you set the privacy level of something you've liked. If the original poster shared publicly, your like is public as well. Remember that if you're a fan of any Facebook groups or pages that like to keep their posts in-group or close to pocket, or it may land in a friend's news feed.

This is EdgeRank in action: it's not sinister, it's just Facebook deciding that your friends may have similar interests and may like what you like.

The downside is that it populates your news feed with photos and updates from pages you may have no interest in, and does the same to your friends. We've shown you how to clean up your own feed, but how do you avoid cluttering up everyone else's feed?

The solution: First, think before you click the Like button. There's no way to determine which likes will be posted to which friends, so before you like that photo on one of your favorite pages, assume that it could be broadcast to all of your friends. Here are some other tips:

  • Hide those pages you like from your profile and set their posting rights to "only me." In our tests, doing this hid the things we liked from those groups from other people's feeds ? but we can't be 100 percent sure it'll work for everyone.
  • Check your activity log. This is the only way to know which of your likes are public and which aren't. (Go to your profile, then click "Activity Log.") You'll see a history of every status update, photo and shared item you've liked, along with an icon that'll tell you whether it's public or shared only with friends. Facebook usually doesn't let you change the visibility of those entries, but you can "unlike" something if you don't want it in someone else's feed with your name plastered over it.
  • Use Social Fixer to tame your own feed. You can use Social Fixer to trim down those types of reliked posts in your own feed, removing the temptation to like them yourself. Still, this doesn't stop Facebook from resharing groups you actually do like with your friends that don't.

Facebook uses your likes to sponsor brands, cluttering up your friends' feeds

The problem: You've seen the ads before: Friend A, B, and C Like [Brand], with a Like button next to it. They're right there in the middle of your news feed ? sometimes there are two or three of them together in a big "sponsored" box.

It's annoying, especially when the brand in question isn't even remotely interesting to you. Save your friends the hassle, and audit the brands and companies you like on Facebook.

The solution: Unlike pages and brands that you don't need an active relationship with, and don't like new ones unless you need to. Save your friends the irritation of seeing "So-and-So Likes A Company You Couldn't Care Less About!" every time they log in to Facebook and just remove brands you don't feel like providing free advertising for.

Don't get us wrong, lots of companies offer great customer service, discounts, and other incentives to like them on Facebook (we'd be lying if we said we didn't want you to like us on Facebook too,) but let's be honest. You probably liked a bunch of companies on Facebook because you shop there and wanted to see what their Facebook page was all about, or because they were running a contest that required you Like them ? not because they offer you any tangible benefit today. Alternatively:

  • Follow the same companies on Twitter instead. Twitter doesn't come with the same commitment that Facebook does, or the same access to your friends. You could also use Twitter lists to stay on top of their deals and coupons without having to like or follow them at all.
  • Set up a second Facebook account for "liking" purposes. A second account, one that you only use for things like promotions and discounts, is invaluable ? stuff it full of as much or as little information as you choose to provide, and then use it instead of your main account. You can even use it as a way to see what's Facebook is sharing from your primary account without you knowing (although the specifics vary from friend to friend.) Note: Facebook's policy is one person-one account, so you'd likely be violating their TOS by doing this. Just something to keep in mind.
  • Adjust your Facebook ad settings. One reader noted that you can also make sure to limit Facebook's ability to use your name and likeness in ads (which they currently don't, but say they may in the future), and how they use your likes and pages to generate ads for others to see. There's even a settings page governing it, even though it's quite buried. Set both options to "No One."

Facebook isn't planning to stop anytime soon

Annoying your friends ? by which we mean making sure that Facebook ads your friends see have your name above them (and vice versa) aren't going anywhere anytime soon.

Facebook's new Graph Search gives you a great way to find people who share interests with you, but it also gives advertisers a great way to cross-reference people's likes and interests so they can better target who should see their brand or product, and which of their friends they should use to say "See? Your friend already likes us, why don't you?"

Now, Graph Search is only limited to a small number of people right now and it respects your privacy settings. If you're smart about keeping your privacy settings where they should be, you don't have anything to worry about from Graph Search. Similarly, it's not certain that Graph Search is even open to advertisers right now, so there's no reason to get out the torches and the pitchforks.

Another example of the same philosophy was Facebook's Social Reader. Graph Search is in the future, but Social Reader is a great example of a Facebook feature that went belly up because people didn't care too much for their activity being shared automatically and without their explicit permission each time it was used.

News sites using Social Reader, like The Washington Post andThe Guardian (the latter of which has already killed their social reader app) saw tumbling numbers last year as readers ditched them en masse. Whether they left because they didn't care for every story they read being automatically shared with their friends (assuming they didn't change post visibility to "only me,") or because they just didn't like what those apps had to offer is still a matter of debate.

The bottom line: Just know what you're getting into

The truth is that Facebook is a free service to users, and it needs to make money somehow, and that money will be made using your data. The question is whether Facebook uses it or they give it to someone else to use, and how that information is used.

The moral of the story here is to be careful with the things you like, because it's not just things you share that end up in your friends' news feeds. Since you can't even go to your profile to see what's been shared on your behalf, it's impossible to tell until someone pings you to ask why you've been liking so many posts from one particular Facebook group lately, or why the only thing you seem to share these days are someone else's photos.

Of course, stay on top of your privacy settings, the post visibility of apps you use (remember: "Only Me" is your friend,) watch what you click "Share" on. Oh, and of course: Every time Facebook makes an arcane change with nebulous results, make sure to update them accordingly.

Payroll tax hike: Some companies could benefit

WASHINGTON -- Companies are rushing to describe the impact of higher Social Security taxes that took effect in January. They paint a bleak picture.

Cash-strapped shoppers are spending less, many U.S. firms warned in earnings announcements over the past few weeks. They are avoiding small luxuries like restaurant meals and fashion items. And they're reconsidering major new purchases. Wherever people chose to cut back, those companies would feel the pinch.

In the past, companies have blamed flu epidemics, earthquakes and SARS for poor results. The trouble, experts and analysts say, is that these high-profile events are only part of the story ? sometimes barely a sliver.

The latest culprit is a 2 percent increase in the Social Security payroll tax, which all U.S. wage earners pay. The rate was reduced temporarily as a measure to boost the economy out of recession, but that "holiday" ended on Dec. 31. As a result, households earning $50,000 will have about $1,000 less to spend this year. A household with two high-paid workers will have up to $4,500 less.

"Any time something like this happens ? whether Hurricane Sandy or the tsunami or the payroll tax hike or uncertainty in Washington ? any company that didn't perform as well as they would have liked gets to say, 'Look, these idiots in Washington are screwing it up for us,'" says Dan Greenhaus, chief global strategist at BTIG, a brokerage firm.

Greenhaus says he is not surprised by the number of companies grousing about payroll taxes. A catchy news hook can help companies "blame a macrotrend for what may be a micro story" about their individual strengths and weaknesses, he says.

There's little doubt that the drop in take-home pay will drag on economic growth. Government economists estimate it will lower economic output 0.6 percent this year.

Yet the tax talk ignores a host of trends, outside events and company-specific factors, analysts say. They say investors should pay closer attention to these factors when considering how a company might perform this year.

Take Darden Restaurants Inc., operator of chains like Olive Garden and Red Lobster. Like other casual sit-down restaurant companies, Darden faces tough competition from chains like Chipotle Mexican Grill and Panera Bread, whose food and prices fall somewhere between fast-food and sit-down fare. Darden's shares slid 28 percent between their recent peak in September and Feb. 21, the day before it lowered its earnings forecast.

But when the weaker forecast was announced, Darden CEO Clarence Otis blamed the payroll tax hike, along with gas prices and winter weather. He said things had looked promising for the restaurant chain in late 2012 until these "difficult macroeconomic headwinds" blew in. Sales dropped because customers had less buying power, Otis said, despite the restaurants' price cuts and promotions.

"They aren't executing as well as their competitors," says Sara Senatore, an analyst at Sanford C. Bernstein who covers the industry.

Fast food diners, generally lower-end than Darden's casual dining clientele, cut spending quickly when taxes rose, said Steve Wiborg, North America president of Burger King Worldwide, on an earnings call last month.

Wal-Mart offered a similar message when it announced earnings, saying its core customers, poor and middle-class Americans, were spending less because of the payroll tax hike, along with higher gas prices and delayed tax refund checks.

Yet Wal-Mart and other discount retailers saw potential benefits from the tax squeeze. Wal-Mart said it is "confident that our low prices will continue to resonate, as families adjust to a reduced paycheck." Dollar Tree executives said last week that their store would provide a welcome alternative for Americans seeking to cut back.

"We're seeing the effect (of the payroll tax hike) on the consumer," said CEO Bob Sasser, "but we think we're part of the solution and a destination for a cash-strapped consumer who's trying to balance their budget."

Discount retailer stocks are rising. The TJX Cos. Inc., operator of T.J. Maxx and Marshalls, is up 6 percent this year, Ross Stores Inc. 7.5 percent and Stein Mart Inc. 16.6 percent. Wal-Mart is up nearly 4 percent since its earnings announcement on Feb. 21, while Burger King has gained more than 9 percent since it unveiled results on Feb. 15.

Like the mid-range retailers and restaurants that can blame their woes on tax policy, lower-end stores may be trumpeting its benefits to them too hastily, says Joesph LaVorgna, chief U.S. economist at Deutsche Bank Securities.

"We don't know much about the first quarter," he said, and retail sales data for recent months have been revised upwards. The tax hike will inevitably hurt consumers in the first quarter, he said, "but that doesn't mean consumer spending is necessarily going to be weak."

Consumers could keep spending and save less money. The job market is improving and so is the housing market.

LaVorgna noted that people have continued to buy more expensive items like cars and trucks, a trend that "seems to run counter to the payroll tax hype, blaming it for all the problems."

In general, economists say, the picture is far more complicated than a small reduction in take-home pay. People may be saving for biggest expenses while cutting back on items typically considered staples.

In its earnings announcement, Home Depot said sales were strongest of items that cost $900 or more ? hardly the marginal purchases that mid-level restaurant chains must worry about, says Brian Sozzi, a retail industry analyst with NBG Productions. The company also did brisk business in flooring, a product set that tends to track renovation activity, a broad driver of spending.

There's no reason to believe the companies are being dishonest about why sales may have weakened. But focusing on the payroll tax, a political hot-button, may be a red herring.

"This might be bad for some companies and very good for others," Greenhaus says. Which companies fall into which group, he said, won't be clear for a few more months.
